1. Insurance
Insurance (accident, liability, theft, etc.) is the responsibility of the participants / guests. In the case of underage participants / guests, insurance is the responsibility of the legal representative.
Insurance is the participants / guests own responsibility. Parents or legal guardians are responsible for participants / guests who have not reached the majority.
2. Scope
By registering or entering the boat, using sports equipment or one of the other Surfup swiss offers, the guest accepts the following general terms and conditions:
The general terms and conditions (GTC) are an integral part of the contract. The scope of these terms and conditions includes all of Patrick Hertig's services, to which Surfup swiss belongs.
3. Risks and dangers
The execution of the various water sports activities and the use of the sports equipment is at your own risk and responsibility. Outdoor and freestyle sports activities inevitably involve certain risks. By booking, the customer declares that he is aware of the risks and dangers associated with water sports. An explicit instruction and clarification by the operator is not necessary for this.
4. Health requirements
Every customer assures that he is healthy and has the necessary physical conditions. In particular, the customer assures that he is free from cardiovascular problems, serious orthopedic problems and illnesses or other health impairments that do not allow physical activity or that affect swimming ability. Personal responsibility, prudence and realistic self-assessment are required from every customer. The operator does not need to explicitly inquire about this.
5. Minimum age
The minimum age for using the activities offered by Surfup swiss is not set by the operator and is at the discretion of the parents. In the case of underage customers, use requires the express written consent of a legal representative or the legal representative must be present during use. The legal representative assures that the underage customer has the necessary health and physical conditions. The legal representative is fully liable for damage to persons, the boat and the equipment caused by the misconduct of the underage customer.
6. Life jackets
For safety reasons, all sports equipment may only be driven and used with swimming or wakeboarding and wakesurfing vests.
7. Life jackets for children under 12 years of age
It is compulsory for children under the age of 12 to carry a suitable life jacket.
8. Security and Disclaimer
Surfup swiss assumes no liability whatsoever for accidents and / or illnesses and / or physical and / or psychological impairments of any kind that the participant suffers during participation or which are direct or indirect consequences of participation, except in cases that are not excluded by law.
Any liability is excluded for valuables and equipment, for example customer material, which is deposited, kept or stored by the operator. It is therefore advisable to take out appropriate insurance for objects you have brought with you and / or accidents yourself. The operator is not liable for weather-related or short-term cancellations of booked sessions in the event of hail, storms, thunderstorms or other weather influences. The decision about the execution of the booked sessions is always made by the operator and, on the boat, by the skipper.
For security reasons, our instructors reserve the right to exclude individual customers from the workshop, to change the program or to cancel the booking prematurely. This is especially true in the case of reckless behavior by one or more customers. In such cases, no compensation or refund can be requested. Participation in the workshop takes place in the awareness that the participant is personally liable for impairments caused by alcohol and the like or by taking medication and the resulting consequences.
Our instructors offer you the greatest possible safety. Nevertheless, a residual risk can never be completely ruled out. With your booking you expressly acknowledge this fact and waive any claims, damages or other liability.
9. Cancellations and withdrawal of the booked services
Booked sessions can be canceled by telephone 24 hours in advance. In the case of short-term cancellations, which the operator cannot replace at short notice to the same extent (e.g. it is no longer possible to fill reserved spaces on the boat), a fee of 50% of your booked service will be required.
10 . Rental equipment
The guest is obliged to keep the rental equipment in a proper condition and to return it. If the rental equipment is returned late, corresponding late payment fees will be charged. In the event of damage or loss, the cost of repair or replacement must be paid by the customer. Rental material is only issued on deposit of a valid ID (personal or driver's license), for a deposit fee or for another fee by arrangement.
11. Pets
It is not permitted to bring dogs or other animals on the boat.
12. Instructions
The instructions of the operator, his employees or the boat operator when using an offer must always be followed.
13. Third Party Liability
Surfup swiss assumes no liability towards third parties who use an offer that is made available by Surfup swiss but is not operated by Surfup swiss itself. In this case, the terms and conditions of the respective operator apply.
We assume no liability for content and other offers from third parties that appear in connection with Surfup swiss.
15. Covid-19 protection concept
This will be part of these terms and conditions from May 12th, 2020 and until further notice Covid-19 protection concept from Surfup swiss on the subject of Covid-19. The protection concept must be read and understood before booking / visiting Surfup swiss (if you have any questions, please do not hesitate to contact us). By booking an offer or visiting Surfup swiss, you declare that you agree to the requirements and adhere to them.
16. Applicable law and place of jurisdiction
The contractual relationships between you and Surfup swiss are subject to Swiss law. Exclusive place of jurisdiction for all im Disputes related to the use of this website are Stans, NW.
17. Offers
The water sports school Surfup swiss offers workshops in the field of water sports. The offer includes, for example, wakesurfing, wakeboarding, wakeskating, water skiing and watering.
18. Implementation & program changes
Unless otherwise communicated, our workshops are carried out. In the case of weather forecasts with heavy rainfall, strong storms, lightning, etc., the instructors reserve the right to make changes in your interest (even when you are out and about).
If the session has to be canceled before the start due to the reasons mentioned above or for other reasons, the participant will receive a notification by email / SMS.
If the session has to be ended prematurely after the start due to the reasons mentioned above or others, there is no right to a refund of the payment.
Should you terminate or interrupt your water sports experience prematurely, no refund will be given.
